as an update for those still concerned:

the DMCA takedown was completed this morning and the user is officially deleted. i’ve seen a few comments that the user replied to messages and apologized, which is more than i’ve seen users on wattpad do previously.

i rarely, RARELY speak about my job but i think, in this instance, it’s important. i will not specifically say what my job is, but i am daily working with intellectual property, copyright, and the digital millennium copyright act. i have seen so many writers on this post express their upset that they don’t actually know how to file a DMCA takedown request and usually are just left messaging users who repost or copy their work. so here are a few things for you to note:

- your original created works, be that gifs, fanfiction, graphics, art etc are considered intellectual property. these works are legally protected and, if you want, you can leave a copyright notice on your page notifying that you do not grant permission for you work to be reposted, changed, spun-off, etc. this also can include translation. over the years i have denied several requests for my works to be translated. trust me. it counts.

- the DMCA covers anything that is digital, and therefore every website will have some form of acknowledgement or form for you to utilize to file a take down request should you find your work on another platform. things to note:

1. only YOU, the original creator, can file a takedown request on your own behalf. you can only file a takedown on behalf of another party if you are the authorized agent (attorney/power of attorney/parent if original owner is under 18) or the original author has granted explicit written consent which can be proved in court of law

2. i recommend you maintain a record of all drafts and posting histories. in many cases, especially in fanfiction, you will need to prove where YOU uploaded your work to create a timeline of ownership. i keep a record of dates and time stamps all my fics were posted. i have an external hard drive that contains only my original work should anything ever need to be proven. i know i sound crazy but it is serious.

3. you will always be required to provide an email or a phone number, in most cases you will be required to provide both. this is because some websites (tho for fanfic i have not seen any do this) will put you in contact with the reposter. this is the ONLY time i will ever be in contact with someone who copies or reposts my work because, as part of the DMCA, the email correspondence is recorded and can be proven.

on wattpad, you can file a DMCA takedown by either googling OR scrolling to the bottom of the story and clicking the ... on the bottom by all the share options. you will see REPORT as the last option. this is the DMCA form. please make use of it.

wattpad takes anywhere from 8-48 hours to respond to these because they are legally required to do so in these time frames. this is not the first time i’ve filed a DMCA with wattpad. they are very responsive.

if you are ever creating, writing, editing, or even thinking of engaging in fan works on tumblr or AO3 or even wattpad i am imploring you to know your rights. you have them. you are protected.
